1. Introduction

Welcome to Play Fun Spot. These Terms and Conditions ("Terms") govern your use of PlayFunSpot.com (the "Website") and all related services (the "Service"), operated by PLAY FUN SPOT LLC (the "Company," "we," or "us"). By accessing the Website, registering an account, or participating in any sweepstakes, you agree to these Terms.

Play Fun Spot is a promotional sweepstakes platform. It is not a casino and does not offer gambling, wagering, or betting of any kind. No money or other thing of value is staked or risked in any game. NO PURCHASE, PAYMENT, OR DONATION IS NECESSARY TO ENTER OR WIN. A DONATION WILL NOT INCREASE YOUR ODDS OF WINNING BEYOND THE NUMBER OF ENTRIES RECEIVED. VOID WHERE PROHIBITED.

2. Changes to These Terms

We may update these Terms at any time. Changes take effect when posted on the Website, and the "Last updated" date will be revised. Your continued use of the Service after a change means you accept the revised Terms. If you do not agree, you must stop using the Service.

3. Eligibility

3.1 Age. You must be at least 18 years old, or the age of majority in your jurisdiction if higher, to register or participate. We verify age during registration and may request proof of age at any time.

3.2 Legal capacity. You must be legally able to enter into a binding agreement with us.

3.3 Location. The Service is offered only to persons physically located in, and residing in, a United States jurisdiction that is not a Restricted Jurisdiction under Section 4. You are responsible for confirming that your participation is lawful where you are located.

3.4 No location masking. You may not use a VPN, proxy, or any other tool to hide or misstate your location. Accounts found doing so will be closed and any entries or prizes voided.

3.5 Personal use. You may participate only for yourself, for personal entertainment, and not on behalf of any other person or for any commercial purpose.

3.6 Excluded persons. Employees, officers, and contractors of the Company and of AFG Assistant, and members of their immediate families and households, are not eligible to win prizes.

4. Restricted Jurisdictions

4.1 The Service is not available to, and may not be accessed by, any person located in or residing in: Arizona, California, Connecticut, Delaware, Idaho, Illinois, Indiana, Iowa, Louisiana, Maine, Maryland, Michigan, Minnesota, Montana, Nevada, New Jersey, New York, Oklahoma, Tennessee, Utah, Washington, West Virginia, or Wyoming, or any location outside the United States, or any other jurisdiction where participation is prohibited (each a "Restricted Jurisdiction").

4.2 We enforce these restrictions through identity verification, address verification, and IP-based geolocation. Registrations, Donations, entries, game access, and prize redemptions from a Restricted Jurisdiction are blocked. Any entry made or prize claimed in violation of this Section is void.

4.3 Payment cards with a billing address in a Restricted Jurisdiction will be declined.

4.4 We review this list regularly and may add jurisdictions at any time. If your jurisdiction becomes a Restricted Jurisdiction, your account will be closed. [Company to confirm how unredeemed, verified prizes are handled on closure.]

5. Registration and Verification

5.1 Registration. To participate you must personally complete the registration form and accept these Terms. Registration is free. We may refuse any registration at our discretion.

5.2 Identity verification. Before you can participate, you must complete our Know Your Customer process, which includes a government-issued photo identification and a real-time selfie match. We also verify your location. We may request additional information or documents at any time, and may suspend your account until we receive them.

5.3 One account. You may hold only one account. Duplicate accounts, including accounts opened by others on your behalf, will be closed.

5.4 Accurate information. You must provide accurate information, including a valid email address (your "Registered Email Address"), and keep it current. We communicate with you through your Registered Email Address. Providing false information may result in account closure.

5.5 Account security. You are responsible for keeping your password and game credentials confidential and for all activity on your account. Notify us immediately if you suspect unauthorized access.

5.6 No transfer. Your account, entries, credits, and any prize rights are personal to you and may not be sold, transferred, pledged, or assigned.

6. How to Enter: No Purchase or Donation Necessary

6.1 Entries on registration. Each newly verified participant receives [number] free entries.

6.2 Free entry by mail. You may request free entries by mailing a handwritten postcard to Play Fun Spot, 6424 Beach Boulevard, Jacksonville, FL 32216. The postcard must include your full name, email address, mailing address, date of birth, the words "AMOE Entry Request," the name of the game to which the entry should apply, and this signed statement: "I certify that I am 18 years of age or older and meet the eligibility requirements outlined in the Official Rules and have verified my identity on playfunspot.com." 

6.3 Free entry by email. You may submit the same information by email to [email protected] or [email protected].

6.4 Entries with a Donation. You may choose to make a voluntary donation to AFG Assistant, a 501(c)(3) nonprofit organization (a "Donation"), through the Website. You will receive one entry for every $10 donated. A Donation is not required to register, enter, play, or win.

6.5 Equal treatment. All entries have the same value and the same odds of winning, however they were obtained. Entries obtained by mail or email are processed in the same manner as entries received with a Donation. 

6.6 Entries have no cash value. Entries and any promotional credits are not money, cannot be purchased, have no cash value, and cannot be exchanged for cash. They may be used only to participate in sweepstakes offered through the Service.

7. Donations

7.1 Voluntary. Donations are voluntary charitable contributions. They are not deposits, stakes, wagers, or purchases of entries or credits, and they are not held in an account for you.

7.2 Payment methods. You may donate only with a payment method registered in your own name. All Donations are processed in U.S. dollars by third-party payment processors, and are subject to authorization by your card issuer.

7.3 Refunds and chargebacks. Donations are handled in accordance with our Refund Policy. If a Donation is reversed or charged back, the entries received with that Donation, and any prize resulting from them, are void.

7.4 Prohibited funds. Donations made with funds from illegal or unauthorized activity are prohibited.

8. Games and Sweepstakes

8.1 Game access. After registration and verification, our team issues you login credentials for the third-party game platform you select. Games are hosted and operated by independent third-party providers. Play Fun Spot does not host, operate, or control the games or their outcomes.

8.2 Allocating entries. You may view open sweepstakes in your account and choose how to allocate your entries among them.

8.3 Odds. The odds of winning depend on the total number of valid entries received in each sweepstakes.

8.4 Supplemental rules. Each sweepstakes may have supplemental Official Rules stating its eligibility, entry period, prizes, and odds. Those rules apply in addition to these Terms.

8.5 Records. Each third-party game provider keeps the record of activity and results on its platform. In the event of a dispute, the provider's records, as verified by us, control.

8.6 Errors and interruptions. If a technical error or malfunction affects a game or sweepstakes, affected entries and results are void and we may correct any credits or prizes issued in error. If you lose connectivity during play, the result is determined by the game provider's records.

8.7 Not transferable between platforms. Credits and results on one game platform cannot be moved to another.

9. Prizes and Redemption

9.1 Prizes. Prizes consist of gift cards, merchandise, or additional sweepstakes credits, as stated in the applicable Official Rules. The value of any individual prize is generally capped at $500.  

9.2 Claiming a prize. To redeem a prize, submit a request through your account. We verify your result with the relevant game provider and confirm your identity and eligibility before fulfilling any prize. We may require additional verification.

9.3 Fulfillment. Verified prizes are delivered to the verified account holder only, within the state where the participant resides.

9.4 Taxes. You are responsible for any taxes on prizes you receive.

9.5 Forfeiture. Prizes are void if obtained through ineligible participation, fraud, error, a reversed Donation, or any breach of these Terms.

10. Prohibited Conduct

You may not: use the Service for any unlawful purpose; cheat, collude, or use software or automation to gain an advantage; collect information about other participants; post or send unauthorized advertising or solicitations; interfere with the operation of the Service; or infringe our intellectual property rights. We may suspend or close your account, void entries and prizes, and take legal action for any violation.

11. Responsible Play

Participation should be for entertainment and, if you choose, to support AFG Assistant. Donate only what you can comfortably afford. If you would like to limit or close your account, contact Customer Support from your Registered Email Address. Requests may take up to 24 hours to process. 12. Account Suspension and Closure

12.1 By us. We may suspend or close any account, and refuse, limit, or void any entry, if we believe these Terms have been breached or to protect the integrity of the Service.

12.2 By you. You may close your account at any time by emailing Customer Support from your Registered Email Address.

12.3 Inactive accounts. An account that has not been used for twelve (12) consecutive months is considered inactive and may be closed. Unused entries and credits expire on closure.

12.4 Underage participation. If we learn or suspect that a participant is under 18, the account will be suspended and, if confirmed, closed. All entries and prizes will be void. Any Donation made by an underage person will be refunded to the original payment method.

13. Payment Processing and Compliance

We use third-party payment processors to handle Donations. All transactions are monitored for fraud and for compliance with anti-money laundering laws, and suspicious activity may be reported to the appropriate authorities.

14. Fraud

We will pursue all available remedies against any participant who engages in fraud or other dishonest or criminal conduct, including voiding entries and prizes, closing accounts, and reporting to law enforcement. You agree to indemnify us for losses caused by your fraudulent or dishonest conduct.

15. Communications

You may contact us through the Customer Support form on the Website. We will contact you by posting on the Website or by email to your Registered Email Address. All communications will be in English. By registering you agree to receive emails about promotions and updates, and you may opt out at any time by contacting Customer Support.

16. Intellectual Property

All content on the Website, including text, graphics, logos, and software, belongs to the Company or its licensors and is protected by law. You are granted a limited, non-exclusive, personal right to use the Service in accordance with these Terms. You may not use our name, logo, or other marks without our written permission.

17. Matters Beyond Our Control

We are not liable for any failure or delay caused by events beyond our reasonable control, including natural disasters, labor disputes, power or telecommunications failures, government action, or failures of third parties, including game providers and payment processors. We may suspend or cancel the Service in those circumstances.

18. Limitation of Liability

18.1 To the extent permitted by law, we are not liable for any indirect or consequential loss, or for any loss caused by your own conduct, by third parties, or by events we could not reasonably have foreseen or prevented. The Service is for personal use only and we are not liable for any business losses.

18.2 Our total liability to you in connection with these Terms will not exceed $500.

18.3 Nothing in these Terms limits liability that cannot be limited by law.

19. Governing Law and Disputes

19.1 Governing law. These Terms and any dispute arising from them or from your use of the Service are governed by the laws of the State of Florida, without regard to its conflict of law rules.

19.2 Informal resolution. Before starting any formal proceeding, you agree to contact Customer Support and give us 30 days to try to resolve the dispute.

19.3 Venue. Any claim not resolved informally must be brought in the state or federal courts located in Duval County, Florida, and you consent to the jurisdiction of those courts.

19.4 Individual claims only. To the extent permitted by law, claims may be brought only on an individual basis and not as part of any class or representative action.
